# Terms and Conditions

These Terms and Conditions (“Terms”) govern access to and use of cbm3.net and the CBM3 websites, calculators, 3D loading tools, account features, content and related services (collectively, the “Service”).
By accessing or using the Service, creating an account, or asking the Service to process information, you agree to these Terms. If you do not agree, do not use the Service.
## 1. Operator

## 2. The Service
CBM3 is a browser-based cargo calculation and loading-planning service. It may provide CBM and volumetric-weight calculations, cargo-row entry, container and load-space comparison, Best Fit recommendations, pallet and floor-load planning, equipment restrictions, alternative loading scenarios, 3D loading simulation, import and export, PDF-ready reports, loading notes, saved plans, plan codes, public sharing and related operational tools.
Features may vary by device, browser, language, data set and technical availability. The Service is a planning aid; it is not a substitute for an engineering assessment, certified load plan or physical inspection.
## 3. Eligibility and Authority
You may use the Service as an individual or on behalf of an organization. You represent that:
– you are at least 18 years old or have reached the age of legal majority in your jurisdiction;
– you have legal capacity to accept these Terms; and
– if you act for an organization, you are authorized to bind that organization.
## 4. Free Access
At the date shown above, CBM3’s normal end-user functionality is provided free of charge. No subscription, trial activation or payment is required to perform calculations or create 3D loading plans.
“Unlimited” or similar wording means that CBM3 does not apply a commercial usage quota to normal use of the free Service. It does not remove reasonable technical and security controls, including file-size, payload, rate, concurrency, processing-time, browser-memory, storage and anti-abuse limits.
CBM3 may change, add, remove or repackage features in the future. A future paid product or service will not create a charge merely because you used the current free Service. Any future price, recurring charge or paid term must be disclosed before the relevant purchase and will apply prospectively.
## 5. Guest Use, Accounts and Storage
An account is optional for normal calculation and planning.
As a guest, you may use the calculator, import and export data, create 3D plans, generate available reports, use plan codes and create public shares. Guest calculations, history and templates are ordinarily stored in the local storage of the browser in which they were created. They are not linked to a CBM3 account and may be lost if you clear browser data, use private browsing, change browser or device, or if the browser removes stored data.
An account is required for account-linked cloud records, dashboard management, workspaces, persistent project ownership and cross-device access. Account features remain free while the Service operates in its current free-access mode.
You are responsible for accurate account information, the security of your credentials and activity under your account. If you use Google Sign-In, Google authenticates your Google account and CBM3 creates or opens the corresponding CBM3 account; CBM3 does not receive your Google password.
Notify admin@cbm3.net promptly if you suspect unauthorized account access.
## 6. Saved Codes and Public Sharing
A guest save code may work only in the browser storage in which the record was created. It is not a substitute for an account-linked cloud backup.
When you deliberately create a public share, the Service may store the information required to open that shared plan on CBM3 systems. A public URL or share code is a bearer link: anyone who receives or discovers it may be able to open the associated content without signing in.
Do not include personal, confidential, export-controlled, security-sensitive or commercially sensitive information in a public share. You are responsible for the recipients you choose, the information you share and the removal or replacement of shared content when it should no longer be available.
## 7. Historical Transactions and Future Paid Services
CBM3 does not currently sell an active paid membership through the normal free-access experience.
Records of historical purchases, invoices, subscriptions or refunds may remain in CBM3 or Paddle systems for customer support, accounting, tax, fraud-prevention and legal purposes. A historical transaction remains governed by the terms, consumer rights and payment-provider rules that applied to that transaction.
Where Paddle processed a historical transaction, Paddle acted as the seller or Merchant of Record and may handle the receipt, tax, billing, cancellation, dispute or refund process. See the Refund Policy for more information.
If CBM3 introduces a paid product in the future, checkout terms, price, billing period, renewal terms and cancellation rights will be shown before purchase. No current free user is automatically enrolled in a future paid plan.
## 8. Acceptable Use
You must use the Service lawfully and responsibly. You must not:
– upload malware or use the Service to distribute harmful or unlawful material;
– probe, bypass or defeat authentication, authorization, rate limits, ownership checks or security controls;
– interfere with, overload or disrupt the Service or its infrastructure;
– use automated access in a way that unreasonably degrades the Service for others;
– scrape or harvest personal data or non-public content;
– access another user’s account, workspace, cloud record or non-public data without authorization;
– misrepresent Service output as a certified engineering, safety or regulatory approval;
– use the Service for fraud, infringement, deception or any unlawful activity; or
– reverse engineer or attempt to extract non-public source code except to the limited extent that applicable law expressly permits and does not allow that restriction to be waived.
Normal use of the Service’s own import, export, PDF, save, share and integration features is permitted.
## 9. User Content
“User Content” means cargo descriptions, dimensions, weights, quantities, notes, customer or project fields, files, plans and other information you enter, import, save or share.
You retain any rights you have in your User Content. You grant CBM3 a limited, non-exclusive, worldwide licence to host, copy, process, transmit, display and technically adapt User Content only as reasonably necessary to provide, secure, maintain and support the Service, comply with law and act on your instructions.
You represent that you have the right to use and submit User Content and that it does not unlawfully infringe third-party rights. Avoid entering personal or sensitive data that is not necessary for cargo planning.
CBM3 may use de-identified and aggregated operational information that does not reasonably identify you or disclose your confidential plan to measure reliability, prevent abuse and improve the Service.
## 10. Intellectual Property
The Service, including its software, interface, design, branding, documentation, content, algorithms and databases, is owned by CBM3 or its licensors and is protected by applicable law.
These Terms give you a limited, revocable, non-exclusive and non-transferable right to use the Service for its intended purpose. They do not transfer ownership of the Service or its intellectual property.
## 11. Third-Party Services
The Service may rely on third parties for hosting, WordPress functionality, authentication, analytics, tag management, email, security and, for historical or future transactions, payment processing.
Third-party services may have their own terms and privacy notices. CBM3 is not responsible for an independent third party’s acts or availability except to the extent required by applicable law.
## 12. Changes, Availability and Support
CBM3 may maintain, update, suspend, limit or discontinue all or part of the Service. We do not promise uninterrupted availability, error-free operation or a minimum uptime.
We will take reasonable care when making material changes, but browser, device, network, hosting and third-party failures may affect operation. Support is provided on a reasonable-efforts basis unless a separate written agreement states otherwise.
## 13. No Professional, Safety or Compliance Advice
CBM3 provides calculations, estimates, simulations and decision-support information only. It does not provide engineering, transport, dangerous-goods, customs, insurance, legal, tax, safety or regulatory advice.
You are solely responsible for real-world loading and transport decisions, including:
– confirming actual internal and door dimensions, payload and axle limits;
– verifying cargo dimensions, weight, centre of gravity and packaging;
– checking stackability, orientation, support, fragility and compatibility;
– selecting pallets, dunnage, lashing, blocking, bracing and securing;
– observing carrier, manufacturer, port, road, air, rail, maritime, customs and dangerous-goods requirements; and
– obtaining any required inspection, approval or professional advice.
You must independently verify outputs before quoting, booking, loading, transporting or relying on them. A visual fit or successful 3D placement does not guarantee that a load is legal, safe, stable, accessible or physically loadable.
## 14. Disclaimers
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”. CBM3 disclaims warranties that may lawfully be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy and availability.
CBM3 does not warrant that every calculation, recommendation, scenario, placement, cost, report or shared record will be complete, current, error-free or suitable for your particular cargo, equipment or jurisdiction.
Nothing in these Terms excludes a warranty or consumer right that cannot legally be excluded.
## 15. Limitation of Liability
To the maximum extent permitted by applicable law, CBM3, Hasan Fatih Duyar and their licensors, contractors and service providers will not be liable for indirect, incidental, special, consequential, exemplary or punitive loss, or for lost profit, revenue, contract, opportunity, goodwill or data, arising from the Service.
To the maximum extent permitted by law, total aggregate liability arising from the Service or these Terms will not exceed the greater of:
1. the amount you paid for the Service during the 12 months before the event giving rise to the claim; or
2. USD 100.
These exclusions and limits do not apply where liability cannot lawfully be excluded or limited, including any mandatory consumer rights and any liability for fraud, wilful misconduct, or death or personal injury caused by negligence where applicable law so provides.
## 16. Business-User Indemnity
If you use the Service on behalf of a business, and only to the extent permitted by law, that business will indemnify CBM3 and Hasan Fatih Duyar against third-party claims, losses and reasonable costs arising from its unlawful use of the Service, its User Content, its breach of these Terms or its unverified real-world use of Service outputs.
This section does not apply to a consumer to the extent it would remove or reduce a mandatory consumer right.
## 17. Suspension and Termination
You may stop using the Service at any time. You may request account closure by contacting admin@cbm3.net.
CBM3 may suspend, restrict or terminate access where reasonably necessary to address a Terms violation, abuse, fraud, security risk, legal requirement, third-party service requirement or material risk to the Service or other users.
On termination, your right to use the affected account features ends. Browser-local guest records remain under your browser’s control until they are cleared. Data handling after account closure is described in the Privacy Policy.
## 18. Governing Law and Disputes
These Terms are governed by the laws of Turkiye, without regard to conflict-of-law principles.
The competent courts and enforcement offices of Turkiye will have jurisdiction, except where mandatory law gives a consumer the right to bring a claim in another court or applies other non-waivable protections.
Before filing a claim, you are encouraged to contact admin@cbm3.net so we can try to resolve the issue informally. This does not limit any statutory complaint or court deadline.
## 19. Changes to These Terms
CBM3 may update these Terms to reflect changes in the Service, law, security or business operations. The updated version will be posted with a new “Last updated” date.
Material changes will apply prospectively. Where appropriate, CBM3 may also provide an in-product or email notice. Continuing to use the Service after the effective date means you accept the updated Terms, unless applicable law requires another form of agreement.
## 20. General
If any provision is held invalid or unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without CBM3’s consent; CBM3 may transfer these Terms as part of a lawful business transfer, subject to applicable rights.
These Terms, the Privacy Policy and the Refund Policy form the agreement governing the Service, unless a separate written agreement expressly applies.
