These Terms and Conditions (“Terms”) govern your access to and use of CBM3 and any related website, software, tools, features, content, and services made available through cbm3.net (collectively, the “Service”).
By accessing or using the Service, creating an account, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

## 2. Description of the Service
**CBM3 is a web-based cargo loading, volume, weight, and freight calculation software.**
The Service may include, depending on the plan and product configuration shown on the Pricing page, features such as cargo and container calculations, freight cost calculations, 3D simulation, optimization tools, exports, saved plans, and related operational tools.
## 3. Eligibility
You may use the Service as a consumer or as a business user. By using the Service, you represent and warrant that:
– you are at least 18 years old or the age of legal majority in your jurisdiction;
– you have the legal capacity to enter into these Terms; and
– if you use the Service on behalf of a company or other entity, you have the authority to bind that entity to these Terms.
## 4. Accounts
To access certain features, you may be required to create an account.
You are responsible for:
– providing accurate and complete registration information;
– maintaining the confidentiality of your login credentials; and
– all activities that occur under your account.
You must notify us immediately at **admin@cbm3.net** if you suspect unauthorized use of your account.
We may suspend or terminate your account if we reasonably believe that you have violated these Terms, misused the Service, or created risk, harm, abuse, fraud, or liability.
## 5. Plans, Pricing, and Access
CBM3 may offer free and paid plans, including but not limited to **Free**, **Starter**, **Professional**, and **Business** plans.
Current plan details, usage limits, pricing, billing periods, and included features are shown on the Pricing page at the time of purchase and form part of these Terms.
The Free plan may include limited use of certain premium features, including limited daily 3D simulation usage, as described on the Pricing page.
We may change plan features, prices, packaging, limits, or availability at any time. Any such changes will apply prospectively unless otherwise required by law.
## 6. Subscriptions and Auto-Renewal
Paid plans may be offered on a recurring subscription basis, including monthly and multi-month billing cycles.
By purchasing a paid subscription, you authorize recurring charges for the applicable subscription fee, taxes, and any other disclosed charges, until you cancel.
– Monthly subscriptions renew automatically each month.
– Business or multi-month subscriptions renew automatically at the end of each billing cycle.
– You may cancel at any time before the next renewal date.
– If you cancel, your subscription will remain active until the end of your current paid billing period, and will not renew afterward.
Cancellation stops future renewals only. Except where required by applicable law or expressly stated in our Refund Policy, no partial refunds or credits are provided for unused time.
## 7. Immediate Access to Digital Services
By purchasing a paid subscription, you expressly request immediate access to the digital Service.
You acknowledge and agree that:
– access to paid digital features may be activated immediately after purchase;
– once performance of the digital Service begins, your right to cancel, withdraw from, or obtain a refund for the purchase may be reduced or lost to the extent permitted by applicable law; and
– your rights, if any, remain subject to mandatory consumer protection laws that apply in your jurisdiction.
## 8. Payments and Merchant of Record
Payments may be processed by third-party payment providers. In some cases, **Paddle** may act as the authorized reseller and Merchant of Record for purchases made through the Service. In such cases, Paddle may appear on your billing statement and may handle checkout, invoicing, tax collection, and certain payment-related support functions.
You agree to provide current, complete, and accurate billing information and authorize all charges incurred under your account.
If a payment is declined, reversed, charged back, or otherwise not successfully collected, we may suspend or terminate access to the paid Service.
## 9. Refunds
Refunds are governed by our **Refund Policy**, which forms part of these Terms.
By purchasing a subscription, you acknowledge that digital services may become non-refundable once paid access has been activated or the Service has been used, except where required by applicable law.
## 10. Acceptable Use
You may use the Service only in compliance with these Terms and applicable law.
You must not, and must not permit others to:
– reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Service;
– scrape, crawl, harvest, or extract data from the Service by automated means;
– overload, interfere with, disrupt, or impair the Service or its infrastructure;
– share accounts or credentials with unauthorized users;
– resell, sublicense, lease, or commercially exploit the Service except as expressly authorized by us in writing;
– use the Service for unlawful, fraudulent, abusive, or deceptive purposes;
– upload malicious code, viruses, or harmful content;
– attempt to bypass plan restrictions, usage limits, or technical protections.
We may investigate violations and take any action we consider appropriate, including suspension, termination, legal action, and cooperation with authorities.
## 11. User Data
You retain ownership of the data you upload to the Service, including product data, dimensions, weights, quotes, and loading plans (“User Data”).
You grant us a limited, non-exclusive, worldwide license to host, process, store, transmit, and use User Data solely to provide, maintain, secure, support, and improve the Service.
We may use anonymized and aggregated usage data for analytics, service improvement, product development, performance optimization, fraud prevention, and business operations.
If your account is closed, we will delete your User Data within a reasonable period, except where retention is required by law, necessary for legitimate accounting, tax, security, fraud prevention, dispute resolution, or enforcement purposes.
## 12. Intellectual Property
The Service, including its software, design, branding, interfaces, content, algorithms, databases, and all related intellectual property rights, belongs to CBM3 and/or its licensors and is protected by applicable intellectual property laws.
Except for the limited right to use the Service under these Terms, no rights are granted to you.
## 13. Availability, Changes, and Support
The Service is provided on an evolving basis. We may add, remove, modify, suspend, or discontinue features, tools, plans, or any part of the Service at any time.
We do not guarantee uninterrupted availability, error-free operation, or any minimum uptime. Temporary downtime, maintenance, updates, technical issues, or third-party failures may occur.
Any support provided is offered at our discretion unless a specific support level is expressly included in a paid plan.
## 14. No Professional, Operational, or Safety Advice
CBM3 provides calculation, planning, estimation, simulation, and decision-support tools only.
CBM3 does not provide professional engineering, transport, customs, insurance, legal, safety, or operational advice.
You are solely and fully responsible for all real-world decisions, actions, and outcomes relating to cargo loading, transport planning, stowage, weight distribution, securing, compliance, insurance, customs, safety, and commercial arrangements.
You must independently verify all outputs, calculations, simulations, dimensions, capacities, and operational assumptions before relying on them in any real-world use.
## 15. Disclaimers
To the maximum extent permitted by law, the Service is provided **”as is”** and **”as available”**, without warranties of any kind, whether express, implied, statutory, or otherwise.
We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, availability, and suitability for operational use.
We do not warrant that:
– the Service will meet your requirements;
– the Service will be uninterrupted, secure, or error-free;
– any calculations, simulations, or outputs will be accurate or suitable for your specific operational use; or
– defects will be corrected.
## 16. Limitation of Liability
To the maximum extent permitted by law, CBM3, Hasan Fatih Duyar, and any affiliates, licensors, contractors, or service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including loss of profits, revenue, business, contracts, customers, goodwill, data, or opportunity, arising out of or related to the Service.
To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service or these Terms shall not exceed the total amount paid by you to us for the Service during the **three (3) months** immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
## 17. Indemnity
You agree to defend, indemnify, and hold harmless CBM3, Hasan Fatih Duyar, and related parties from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from:
– your use or misuse of the Service;
– your violation of these Terms;
– your violation of any law or third-party right; or
– your User Data or real-world operational use of Service outputs.
## 18. Termination
You may stop using the Service at any time.
We may suspend or terminate your access, account, or subscription at any time, with or without notice, if:
– you violate these Terms;
– payment is not received or is reversed;
– your use creates legal, financial, technical, reputational, or security risk; or
– we are required to do so by law or service provider requirements.
Upon termination, your right to access and use the Service ends immediately, except that paid access already validly purchased may continue until the end of the current billing period where required by our cancellation rules or applicable law.
## 19. Governing Law and Jurisdiction
These Terms are governed by the laws of **Türkiye**, excluding conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of **Türkiye**.
If mandatory consumer protection laws in your jurisdiction give you additional rights that cannot be waived, those rights remain unaffected.
## 20. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date.
If changes are material, we may take reasonable steps to notify users, such as by email or in-product notice. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the updated Terms.
